  1. What these terms cover

These terms govern the use of the website rushlot.com, the Rushlot desktop app for Mac and Windows, the Rushlot account and the paid plans (together, “Rushlot” or “the service”). They are both terms of use and terms of sale.

Rushlot is published by TB Dev, the trading name of Thomas Berthou, EI (entrepreneur individuel), , SIREN 938 157 062, VAT FR96938157062 (“we”). Contact: contact@rushlot.com. The full legal notice is on the legal notice page.

You accept these terms when you create an account or pay for a plan. They form one contract with the acceptable use policy; the privacy policy explains what we do with personal data. You must be at least 18 and able to enter into a contract.

Some rules below apply only to a consumer, a person acting outside their trade or profession, or only to a professional. Whatever these terms say, a consumer keeps every right the law of their country does not allow a contract to remove.

    Last updated: 28 October 2026.

  2. What Rushlot does

Rushlot helps you prepare your own stock footage for Adobe Stock, Shutterstock, Pond5 and Getty Images. It checks each clip against the marketplace’s published specifications, drafts a title, a description and keywords from the title you gave the clip and from still frames, and, once you approve a clip, uploads the file and its metadata to your own marketplace accounts, from your computer.

    • Rushlot never submits. On every marketplace, the final submission for review is yours: you press the button on the marketplace yourself. Uploading is not submitting.
    • Nothing is sent without your approval. You review each clip and its metadata in the app before it goes anywhere.
    • The metadata is drafted by artificial intelligence (Anthropic’s Claude model) and can be wrong: a species, a place, a date, an editorial caption. Species names are checked against the WoRMS and GBIF registries, but a check is not a guarantee.
    • Rushlot may hold a send. When a marketplace changes its site or it is not safe to send right now, the app waits rather than risk your account.

Rushlot is a tool. It is not a marketplace, an agent or a distributor of your footage, and it publishes nothing: the marketplaces review, publish and license your clips under the contributor agreement you have with each of them. Rushlot is not affiliated with, endorsed by or a partner of any of them; their names are their owners’ trademarks.

No promise of results. Each marketplace decides alone whether to accept a clip, how to rank it, and whether to keep your account open. We do not promise that a clip will be accepted, found, sold or earn anything, and figures on our website (time saved, for example) are estimates, not commitments.

  3. Your account

You sign in with your e-mail address and a link we e-mail you. Use an address you control and keep it up to date: it is where we send everything about your contract.

    • One account per person. It is personal: do not share it or sell access to it.
    • You are responsible for what is done from your account and from the computers signed in to it. Tell us at once at contact@rushlot.com if you think someone else is using it; we can sign a computer out.
    • You confirm that you are not subject to sanctions of the European Union, the United Nations or the United States, and that you do not use Rushlot from a country under a general embargo.
  4. Plans, prices and payment

    • Free trial: 20 clips over the life of your account, with no card and no time limit. It never turns into a paid plan on its own. One trial per person.
    • Pro: a subscription, paid monthly or yearly, with 150 clips each calendar month. Clips left at the end of a month do not carry over.
    • Clip packs: a one-off payment for a number of clips, which do not expire while your account is open and we operate Rushlot.
    • Founder: when it is on sale, a one-off payment for 100 clips each month for life, meaning for as long as we operate Rushlot, limited to 200 seats.

A clip is counted when you approve it for sending, never while Rushlot checks, drafts or transfers it. Rushlot uses your monthly clips first, then what is left of the trial, then your pack clips.

The plans, their content and their prices are those shown on the pricing page and at checkout when you order. Prices are in euros and include any tax that applies. Before you pay, the checkout shows what you are buying, its price and how it renews, and lets you correct your details. The contract is concluded when the payment is confirmed.

You pay in advance, through Stripe’s checkout page; the payment is processed by Stripe Payments Europe, Limited, and we never see your card number. An invoice is issued for every payment. If a payment fails, Stripe tries again; until it succeeds, the paid clips are paused, and the plan may end if the payment stays unpaid. A professional who pays late also owes late-payment interest at three times the French legal interest rate and the fixed €40 recovery fee (Code de commerce, Art. L441-10).

  5. Renewal and cancelling

    • Monthly Pro has no fixed term: it renews every month until you cancel.
    • Yearly Pro runs for one year and renews for another year unless you cancel before the renewal date. We remind you by e-mail between three months and one month before each renewal, with the date by which you can stop it. If we fail to, you may cancel at any time after the renewal at no cost, and we refund within 30 days the part paid for the time after you cancel (Code de la consommation, Art. L215-1).

You can cancel at any time, in a few clicks, from your account in the app, which opens Stripe’s billing portal, or by writing to contact@rushlot.com. We confirm the cancellation by e-mail, with the date it takes effect. It takes effect at the end of the period already paid: you keep your plan until then, and the period started is not refunded, unless Section 6, Section 14 or the law provides otherwise.

When a plan ends, your account stays open on the free trial with whatever trial and pack clips it has left. To close the account itself, write to contact@rushlot.com; what happens to your data then is in the privacy policy.

  6. Your right of withdrawal

If you are a consumer, you may withdraw from a paid contract within 14 days of concluding it, without giving a reason (Code de la consommation, Art. L221-18).

    • If you did not ask us to start straight away, you owe nothing and we refund everything you paid.
    • If, when ordering, you expressly asked us to start before the 14 days end, you can still withdraw, but you pay for what was supplied until you told us (Art. L221-25): the share of the price that matches the clips you approved for sending out of those your purchase includes (150 for a month, 1,800 for a year, the size of a pack). For a Founder seat, each clip approved counts at the monthly Pro price per clip, up to the price you paid.
    • If you asked us to start straight away, acknowledged that you would then lose the right of withdrawal, and the purchase was fully used within the 14 days (every clip of a pack, for example), the right of withdrawal no longer applies (Art. L221-28).

To withdraw, tell us clearly before the 14 days end, by e-mail to contact@rushlot.com or with the form below. We confirm receipt and refund you within 14 days of your message, with the means of payment you used, at no cost to you.

Model withdrawal form (complete and return this form only if you wish to withdraw from the contract)

To TB Dev, Thomas Berthou, , contact@rushlot.com:

I hereby give notice that I withdraw from my contract for the supply of the following service: [plan or pack]. Ordered on: [date]. Name: [your name]. Address: [your address]. E-mail of the Rushlot account: [address]. Signature (only if this form is sent on paper). Date: [date].

  7. Your responsibilities

You decide what you film, what you send and where. Rushlot cannot check what only you know, so the following are yours alone:

    • Your rights in each clip. You own it or hold every right needed to license it, and you hold the model releases, property releases and permits it needs: for the people who can be recognised, private property, artworks, logos and trademarks in shot, and places where filming needs permission.
    • Editorial or commercial. You choose how each clip is licensed and make sure the choice matches what the marketplace allows. The app suggests; you decide.
    • Each marketplace’s rules. You follow the contributor agreement and the guidelines of each marketplace you send to, including its rules on duplicates, on metadata and on disclosing how footage was made.
    • The metadata you approve. You read every title, description and keyword before approving a clip, and you correct what is wrong. Once you approve it, it is your metadata.
    • The submission. You submit on the marketplace, yourself, when you have checked what was uploaded.
    • Your marketplace accounts. You use only accounts that are yours or that you are authorised to manage, and you keep their passwords safe. Rushlot keeps them in your computer’s own protected storage and uses them only to upload what you approved.
    • Your files. Rushlot works on copies and never changes your original files, but keeping backups of your footage is your job.
    • Your income. You declare and pay the tax on what the marketplaces pay you.
  8. Your footage stays yours

Your clips, their titles and the metadata Rushlot drafts for you belong to you. We claim no right in them.

You give us only the limited, non-exclusive, free licence needed to run the service for you: to receive the still frames, titles and keywords the app sends, to have them analysed to draft your metadata and to send the result back to your app, for the time that takes. We store none of it, we do not use it to train any model, and Anthropic does not train its models on it either.

If you send us an idea or feedback, we may use it to improve Rushlot, without owing you anything for it.

  9. Data protection for your footage

A frame can show a person, a car’s number plate or a house; a title can name a place, a person or a date. For that personal data, you are the controller and we process it only on your behalf, as your processor (GDPR, Art. 28). This section is our data processing agreement.

    • What, why and how long: the frames, titles, file names and keywords the app sends to draft metadata, about the people who appear in your footage or are named in it; processed only to draft and return your metadata, for the time of each request.
    • Your instructions: these terms and what you ask for in the app are your documented instructions. We follow nothing else, and we tell you if an instruction seems to us to break data protection law.
    • Confidentiality and security: only the publisher can reach the service’s systems, and every subprocessor is bound to confidentiality. Data travels encrypted, we keep no copy, and our logs hold only an outcome code (GDPR, Art. 32).
    • Subprocessors: you authorise those listed in Section 4 of the privacy policy for this processing, today Vercel (our server) and Anthropic (the model). Anthropic deletes what it receives within 30 days, or keeps it up to 2 years if its safety systems flag it. We tell you by e-mail 30 days before adding or replacing one; if you object, you may end the contract and we refund the unused part of what you paid in advance. Transfers outside the EU rest on the safeguards in Section 5 of the privacy policy.
    • Help we give you: with the requests of the people concerned, with security, with breach notifications (we tell you without undue delay after learning of a breach) and with any impact assessment, using the information we have. As we keep nothing, there is nothing to return or delete when the contract ends.
    • Proof: we answer your reasonable questions on how we meet this section. An audit is possible once a year, at your cost, with 30 days’ notice and under confidentiality.

As controller, it is you who has a lawful basis for filming and selling the footage, informs the people concerned where the law requires it and obtains their releases.

  10. The Rushlot software

The app, the website, the drafting service, their code and design, and the Rushlot name and logo belong to us. Rushlot is licensed, not sold.

While your account is open, we give you a personal, non-exclusive, non-transferable licence to install the app on computers you control and use it, within the limits of your plan, to prepare and send footage to marketplace accounts that are yours or that you are authorised to manage. Open-source components in the app stay under their own licences, listed with the app.

You may not copy, resell, rent or lend Rushlot, give others access to it, remove its notices, get around its plan limits or security, or decompile or reverse engineer it, except where the French Intellectual Property Code allows (Art. L122-6-1). The detail is in the acceptable use policy.

The app checks for updates. Some are needed to keep sending, because the marketplaces change their sites and rules; we may stop supporting an outdated version.

  11. Warranties

If you are a consumer, you have the legal guarantee of conformity for digital content and digital services (Code de la consommation, Art. L224-25-12 and following). For a subscription, we answer for any lack of conformity that appears while it runs; for a pack or a Founder seat, for two years after the purchase. You may ask us to bring the service into conformity, free of charge and within a reasonable time; if we cannot or do not, you may ask for a price reduction or end the contract. Write to contact@rushlot.com.

For everyone: we run Rushlot with the care expected of a professional, but we do not promise that it will be available without interruption, nor that it will work with a marketplace that changes or closes its site or its upload channel. The metadata it drafts is a proposal for you to check (Section 7).

If you are a professional, the service is provided as it is, and, as far as the law allows, we give no warranty beyond those in these terms, in particular none of fitness for a particular purpose.

  12. Liability

What we never limit: our liability for death or personal injury, for gross negligence or wilful misconduct, and any liability the law does not allow us to limit.

If you are a consumer, we are liable under French law for the damage that our failure to perform these terms directly causes you and that could be foreseen when the contract was made (Code civil, Art. 1231-3 and 1231-4). We are not liable for damage caused by your own breach, by a third party, or by force majeure (Art. 1218). A marketplace’s decision to refuse a clip, remove it, or limit, suspend or close your account is its own: we answer for it only if it results from our failure to perform these terms.

If you are a professional, as far as the law allows:

    • we are not liable for indirect or consequential loss, including lost royalties, sales, income or opportunity, harm to reputation, lost data, or the refusal, removal or suspension of clips or accounts by a marketplace;
    • our total liability, for all claims together, is capped at the amounts you paid us in the 12 months before the event that caused the damage;
    • any claim must be brought within one year of the day you knew or should have known the facts behind it (Code civil, Art. 2254).

Your guarantee: you hold us harmless against any third-party claim, and its reasonable costs, arising from your footage, from metadata you approved, or from your breach of these terms or of a marketplace’s rules. If you are a consumer, this applies only to the extent the damage results from your fault.

  13. Suspension and termination

We may suspend your account, or hold your sends, without notice when it is needed to stop a breach of the acceptable use policy, protect the service, your marketplace accounts or other users, obey the law or an authority, or when a payment is unpaid. We tell you why, unless the law forbids it, and lift the suspension once the cause is gone. A suspension does not end the contract.

We may end the contract by e-mail if you seriously or repeatedly breach these terms or the acceptable use policy: at once for a serious breach, otherwise if you have not remedied it 15 days after our notice. The period already paid is then not refunded, unless the law requires it.

We may also stop Rushlot, or end your contract, for any other reason, with at least 90 days’ notice by e-mail. We then refund the unused part of any period paid in advance and the unused clips of your packs.

When the contract ends, your licence to use the app ends with it. Your clips, your app’s database and everything on your computer stay yours. Sections 8, 10, 12, 15 and 16 survive the end of the contract.

  14. Changes to Rushlot and these terms

Rushlot evolves, and so do the marketplaces. We may change the service to keep it working, secure and lawful, to follow a marketplace’s changes or to improve it, at no extra cost to you. If a change makes the service you paid for noticeably less useful to you, we tell you by e-mail beforehand, and you may end the contract free of charge within 30 days of our message or of the change, with a refund of the unused part of what you paid in advance (Code de la consommation, Art. L224-25-25 and L224-25-26).

We may change these terms. We e-mail you any change that affects you at least 30 days before it applies; you may cancel before then if you do not accept it. A change of price applies only from your next renewal after that notice. A change required by law or by security may apply sooner, and a change of wording that alters nothing may apply at once. The version in force is always on this page, with its date.

  15. Disputes and law

If something goes wrong, write to contact@rushlot.com: most problems are settled there. You may go to court at any time.

Law. These terms are governed by French law. A consumer who lives in another country keeps the protection of the mandatory rules of that country’s law (Regulation (EC) 593/2008, Art. 6).

Courts. A consumer may bring a case before any court the law allows, including the court of the place where they live (Code de la consommation, Art. R631-3; Regulation (EU) 1215/2012, Art. 18). For a professional, and where the law allows such a clause, the courts of Bordeaux, France, have jurisdiction.

  16. General provisions

    • Whole agreement: these terms and the acceptable use policy are the whole contract between you and us about Rushlot.
    • Severability: if a clause is held invalid, the rest stays in force.
    • No waiver: not enforcing a clause at once does not mean giving it up.
    • Transfer: you may not transfer the contract without our agreement. We may transfer it to whoever takes over Rushlot, if that does not reduce your rights; we tell you beforehand, and you may then end it.
    • Notices: we write to the e-mail address of your account; you write to contact@rushlot.com.
    • Language: these terms are written in English, and the English text is the one that applies. A French version is provided for consumers in France; if the two differ, the French version applies to a consumer living in France. Any other translation is for information only.
